Business Litigation and Fraud Litigation
In recent years we have seen more of the following kinds of fraud litigation here in Colorado Springs. My firm acts on behalf of both plaintiffs and defendants in corporate law claims as:
- Business fraud - misrepresentation in connection with business transactions.
- Breach of fiduciary duties among business owners and partners and their creditors.
- Fraudulent conveyances - it is quite common for companies or business persons to transfer property when they are under pressure from creditors. Such transfers can result in claims by creditors that result in the court "undoing" the transfer or a judgment against the transferee if the creditor can show that it was harmed.
- Interference with business advantage - Colorado recognizes a business tort based on taking a business opportunity or interfering with business relations in a way that damages another unfairly.
- Alter ego theory - litigation arising when a plaintiff attempts to prove that a corporation is a front for a single person or a group of people. This can destroy the protection the defendant may have tried to create by forming the corporation.
- Limited liability companies/Partnership - dissolution disputes often arise among partners who need a "business divorce" but cannot agree with each other or believe they have been defrauded.
- Franchise law litigation - generally, these claims are subject to arbitration agreements which place heavy burdens on franchisees to prove breach of contract claims, often in other jurisdictions. These are typically fact-driven lawsuits.
